The Court noted that Bayview was continuing to incur attorney?s fees, which would ultimately be added to the total amount of the judgment, and that Jomar?s surety was only liable up to the face amount of the bond. According to the Court, the prospect that Bayview could be left with a partially unsecured judgment is a harm that is irreparable on final appeal.

Pakistan factory owners in deadly blaze get bail

KARACHI, Pakistan (AP) ? A Pakistani court granted bail to three owners of a garment factory in the southern city of Karachi where a fire this week killed 258 people, a defense lawyer said Friday, infuriating families of those who perished in the country's worst industrial accident.

Pakistani police have opened a murder case and are investigating whether possible negligence by the owners and managers of the garment factory led to the massive loss of life in the Tuesday night fire.

The horrific way the factory workers died has infuriated many Pakistanis. People caught in the basement suffocated when it filled with smoke while those on the higher floors were forced to break through metal bars over the windows and jump for their lives to the ground below.

News that the men had been granted bail without even being arrested, a legal practice in Pakistan which allows people to avoid jail, outraged families still grieving their dead.

"The owners of the garment factory should be arrested and hanged as quickly as possible," said Zaitoon Bibi, who lost her son in the fire. "I do not think I will get justice as these owners are powerful and rich."

A lawyer for the men, Amir Mansoob Qureshi, said the judge instructed the police that the factory owners cannot be arrested for eight days under bail terms. The court also asked the owners to surrender their passports and ordered them not to leave the country, the lawyer said.

He said the men went to the city of Larkana, north of Karachi, to ask for bail because they feared for their safety in Karachi.

One of the factory owners, Arshad Bhaila, blamed the city's firefighters for the deaths, saying in televised comments that they arrived late to extinguish the blaze.

In his first public comments since the disaster, Bhaila said they would look after all the families of the dead and injured.

The blaze was the deadliest industrial accident in Pakistan's 65-year history, and highlighted the woeful safety conditions that exist at many factories around the country.

An officer at Karachi's central fire station, Hasan Raza, said firefighters had been dispatched to the scene almost immediately. Within an hour the blaze had been designated as the highest priority, and 26 fire engines were on the scene, he said.

Survivors said they had only one way out of the building since the factory's owner had locked all the other exit doors after a recent theft. Bhaila denied that they had locked the doors.

The fire started when a boiler exploded and the flames ignited chemicals that were stored in the factory, which manufactured jeans and other clothes for export.

In a separate development Friday, security officials briefly arrested the son of the recently ousted Pakistani prime minister for his alleged role in helping two pharmaceutical companies obtain huge amounts of ephedrine for drug trading, his lawyer said. He was taken into custody just before he was to appear at a hearing before the Supreme Court.

Officers from the anti-narcotics force, a military-backed law enforcement agency, arrested Ali Musa at the Supreme Court gates on Friday, said Musa's lawyer, Khalid Ranjha. Musa is the son of former Prime Minister Yousuf Raza Gilani.

Gilani's son is accused of using his political influence in 2010 to get the ephedrine for two pharmaceutical companies. They are suspected of diverting it to people in the drug trade. Ephedrine can be used to make methamphetamines.

Musa has denied the charges.

The arrest warrant was issued in June, but Musa has been in hiding. He was supposed to appear in front of the court to see whether he could receive bail. But before he could get there, police threw him in a vehicle and sped away, the lawyer said.

The court then demanded he be released, which authorities did, and then he was granted bail.

CHARLOTTE, North Carolina (Reuters) - Jumping to the defense of an ex-adversary, former U.S. President Bill Clinton will argue on Wednesday that Americans must re-elect President Barack Obama to restore a vibrant economy that creates jobs.

Clinton, the Democrats' most popular elder statesman, caps the second night of the Democratic National Convention with a speech designed to remind voters of the budget surpluses and job growth he led in the 1990s during his two terms in the White House.

Obama needs Clinton's help to recapture some of the magic that carried him to victory in 2008. The president is struggling to rekindle strong job growth and faces a tough fight against Republican Mitt Romney at the November 6 election.

Clinton will appeal for more time for Obama to fix the economy and reduce the jobless rate of 8.3 percent, according to excerpts of a speech to be delivered later.

"He inherited a deeply damaged economy, put a floor under the crash, began the long hard road to recovery, and laid the foundation for a more modern, more well-balanced economy that will produce millions of good new jobs, vibrant new businesses, and lots of new wealth for the innovators," Clinton will say.

'CANDID' RELATIONSHIP

The two men have had strained ties at times, going back to the bitter 2008 Democratic presidential primary battle when the former Illinois Senator defeated Clinton's wife, Hillary Clinton. But Clinton has since campaigned energetically for Obama.

Asked by NBC News about his relationship with Obama, Clinton was frank: "It's quite good, actually. It's candid, it's open. We haven't been close friends a long time or anything like that, but he knows that I support him."

Clinton rejected the criticism of Obama's economic leadership leveled by Romney and fellow Republicans at their own convention last week in Tampa, Florida.

"In Tampa, the Republican argument against the president's re-election was pretty simple: We left him a total mess, he hasn't finished cleaning it up yet, so fire him and put us back in," Clinton will say, according to the excerpts.

Clinton's appearance was to be the capstone on a sometimes chaotic day at the Democratic convention in Charlotte, North Carolina where Obama had to personally intervene to force back into the party platform language declaring Jerusalem to be the capital of Israel.

The wording was omitted from the document to show more even-handed support in the Arab-Israeli dispute. But that risked angering Jewish-American voters who are a key Democratic constituency.

In an embarrassing development after a strong start to the convention on Tuesday, it took three voice votes to bring back the language.

Forecasts of thunderstorms put a crimp on Obama's nomination party, forcing Democrats to move his planned acceptance speech on Thursday from a 74,000-seat outdoor football stadium to a much smaller indoor venue.

The shift to the Time Warner Cable Arena was a setback for Obama, who hoped to create a visual spectacle in Charlotte's Bank of America stadium on Thursday to rival his 2008 acceptance speech in a football stadium in Denver.

It was also a letdown for tens of thousands of Obama supporters from around the country who had been given tickets to the biggest speech in Obama's campaign.

CHARLOTTE, N.C. (AP) ? President Barack Obama's decision Wednesday to scrap plans to accept his Democratic nomination before a massive crowd outdoors was as much about trying to mitigate political risk in a key battleground state as it was about public safety.

His party blamed severe weather forecasts in announcing that Obama would host the final night of his convention indoors instead of at a 74,000-seat football stadium. But Democrats also worried Obama's leadership would be questioned and he would anger voters in the closely contested state if changed venues at the last minute or held a rain-soaked event.

Republicans dismissed the Democrats explanation, arguing that Obama didn't have enough support to fill Bank of America Stadium in a state that he's struggling to win.

Obama squeaked out a victory in North Carolina in 2008, but polls show him trailing Republican rival Mitt Romney two months from Election Day.

The weather call means the president now will address a far smaller crowd indoors in the same hall where Democrats have gathered for the first two days of their convention. The Time Warner Cable Arena will be set up for about 15,000 people ? mostly official convention participants ? when Obama speaks.

That's just slightly larger than the president's biggest crowd this election cycle, though an audience of millions will be watching on television. Vice President Joe Biden will also speak Thursday at the indoor arena.

Republicans, who canceled the first day of their convention due to weather in Tampa, Fla., accused Democrats of downgrading their events because of low enthusiasm.

"You can't believe a thing this administration says," said former New Hampshire Gov. John Sununu, a Romney backer. "Their campaign promised you rain or shine the president would be speaking there. Then when they couldn't get a crowd, they brought it inside. I think those facts speak for themselves."

Democratic officials had said earlier this week that Obama would speak outside if it were raining, but not in the event of severe weather. The National Weather Service said there is a 40 percent chance of thunderstorms on Thursday afternoon, dropping to 20 percent by the time the president was scheduled to speak in the 10 p.m. hour.

It has rained every day since Saturday in Charlotte. Strong storms brought downpours of nearly an inch Monday and Tuesday.

Obama's team feared the threat of storms could cause some people to stay home, leaving the president speaking to a half-empty stadium. They worried that a last-minute move inside would leave tens of thousands of people in downtown Charlotte with nowhere to go. They also fretted about the possibility of anti-Obama hecklers acquiring some of the free tickets to the event and disrupting the president's speech.

Obama aides insisted the president would have filled the outdoor stadium if they had proceeded with that plan. Campaign spokeswoman Jennifer Psaki said more than 65,000 people had signed up for credentials to attend the outdoor speech and that 19,000 more were on a waiting list.

The consolation prize for those who planned to be at the stadium: a Thursday afternoon conference call with the president.

"We will work with the campaign to ensure that those unable to attend tomorrow's event will be invited to see the president between now and Election Day," said Steve Kerrigan, the convention CEO.

Obama's campaign had planned to use the larger public rally to help boost voter registration and recruit new volunteers. Those efforts will be hampered by the move indoors, but the campaign still has voter information from the 65,000 people who signed up for credentials.

In 2008, Obama accepted the Democratic nomination before a capacity crowd of 84,000 people at an outdoor stadium in Denver. His campaign turned the event into a massive voter registration and recruitment drive that they credit with helping Obama carry Colorado.

Delegates gave the move indoors mixed reviews.

Louisiana delegate Charles Kincade said he was disappointed by the decision.

"I know there are a lot of people who had their hearts set on seeing Obama," he said.

Jan Bauer, a delegate from Ames, Iowa, said she was thrilled about the move 'because it's not very comfortable sitting in the rain."

The venue switch is sure to be a costly letdown, if the 2008 Democratic convention is any guide.

Charlotte convention organizers have been guarded about their expenses and won't have to publicly report them until October. Federal campaign records from the Democratic convention in Denver show that the host committee spent more than $760,000 just to rent the outdoor stadium, not counting all the costs of outfitting it for Obama's acceptance speech.
